Yes, anyone can be a victim of parking tickets

Scott O’Brien, a frequent PP commenter, has a long post on his own blog about, among other things, the parking ticket given to former Peoria City Council member Marcella Teplitz. She complains that the ticket for parking too far away from the curb in front of the Peoria County Courthouse. She told Phil Luciano that she indeed did violate the letter of the law, but that her car was not in the driving lane and was not endangering anybody.

Like Scott, I find Marcella a poor choice for victim, for reasons he has stated and others.

But I do think she’s right and I agree with her conclusion — and others’ — that the city seems determined to drive business out of downtown Peoria.

But then, I’ve been saying the same thing for a while now.

And I got a huge belly laugh out of reading that Peoria police Sgt. Mannie Russell, in charge of the city’s parking enforcement, thinks the ticket writers are nitpicking anybody. The guy needs to get a job as a stand up comedian if he can tell whoppers like that with a straight face.

God, I hate agreeing with Marcella Teplitz about anything.

    What exactly is your recommendation for the City of Peoria regarding parking? Free parking for all of downtown? Pay for parking but no enforcement? Change the parking laws so that you need only be “in the general vacinity of a meter”? I get the impression from your posts that you feel no parking violation is ever worthy of a ticket, and any attempt at law enforcement is a disincentive to go downtown. So, what’s your solution?

    I do NOT buy into the defense given that all the parking enforcement officers are doing is enforcing the laws, that they don’t write the laws, they just enforce them.

    Bull.

    Police do not as a matter of routine give tickets for driving 56 in a 55 mph highway. Police, as a matter of routine do NOT ticket every jaywalker. Police are CONSTANTLY making decisions whether or nor to enforce this or that law. But with parking, the policy is to be follow the book exactly. That’s why people are given tickets for parking a few inches too far past the parking meter. That’s why they are ticketed for parking a little too far away from the curb.

    If the police department cannot screw together the collective number of brainc ells necessary to understand this, then I say it is time to fire all the parking control officers and rip out the parking meters.

    Basically, Dubya is not over his “snit” like he said he was.
    Bill done the crime so he had to do the time (or “drop a dime” that keeps the rhyme). Bill decided to plead guilty - that was his OPTION. (quite frankly, I think more than a few commenters would have testified on his behalf had he pled insanity).
    If this hadn’t happened to him, he’d probably be snickering at Marcella Teplitz right now.
    Bill is complaining because someone DID THEIR JOB and enforced the law. Enforcing the law except for you is not “common sense.”
    Bill broke the law. Marcella broke the law. If you don’t LIKE the law, get it changed. Don’t just complain, work towards getting it fixed.

    This post should have been called “Yes anyone can be the RECIPIENT of parking tickets”.

    She must be off her rocker. How the hell can you be parked too far away from the curb and NOT be in the driving lane?

    The police (and parking enforcement) are in a no win situation, as they usually are. As soon as someone gets a citation for something, the officer was just picking on them by following the law and not using their “discretion”. As soon as the officer does not write the citation or lets someone go, you have a dozen people yelling at them or calling into 600 SW Adams to complain on the officer for not doing their job.

    I find it funny that an elected public official would complain about getting a simple citation for violating a parking law but these same types of officials will quickly tell an officer who has stopped them who they are to attempt to avoid a citation.

    There are three common factors with Mr. Dennis and Ms. Tepliz:
    1. They both parked illegally (by their own admissions)
    2. They both received parking citations
    3. They both paid or said they would pay the citation

    Sounds to me like Sgt Mannie Russell and the parking enforcement division of the Peoria Police Department are doing their jobs, but yet people are still complaining……typical.

    I got a parking too far from the curb in downtown Peoria in the middle of the winter. It was impossible to get any closer to the curb “cause the snow was piled up too high for me to leap over or even see the curb. The keen eyed ticket giver probably had a hard time finding the curb. I just got angry, had a good laugh and paid the fine.

    Sorry Little Lady, but I cuss under my breath at people who park incorrectly in a spot and blame it on the snow. It turns out the parking space’s size doesn’t change due to a pile of snow or snow covering the lines. Bad excuse. It’s a good thing you realized that and paid the fine.
